Conduct Rules and Regulations
NEIGHBOURLINESS
Owners/tenants shall not contravene or permit the contravention of any law, by-law, ordinance, proclamation, statutory regulations or the conditions of any license relating to or affecting the occupation of the units or the use of the common property.
Owners/tenants shall not do anything too, or in their units or the common property which is likely to prejudice the harmonious co-existence of all other owners, and the character and appearance of the premises.
As a sectional title property owner, you hold legal ownership of a specific section or unit. Additionally, all owners in the sectional title become co-owners of the complex or estate’s communal areas. Based on the house rules, you may also be granted exclusive use of certain areas, like a garden. Owners/tenants are allowed to create gardens in their immediate surroundings and to erect fences as long as it is in accordance to the existing standard.
No business or hobby which may disturb residents will be allowed.
The volume of electronic instruments (tv, radio, hi-fi) must be maintained at all time at such a level that it does not disturb anyone.
Mechanical equipment (lawnmowers etc.) may only be used on weekdays from 08:00 – 17:00.
LETTING OF UNITS
All tenants of units and other persons granted rights of occupancy by any owner of the relevant unit are obliged to comply with the conduct rules, notwithstanding any provisions to the contrary contained in any lease or any grant of rights of occupancy.
All tenants must be informed by the owners of the rules and regulations.
No more than six persons are allowed to occupy a single 3 bedroom unit. No more than four persons are allowed to occupy a single 2 bedroom unit.
Owners must inform the managing agent and the trustees of new tenants moving in or out and provide them with their names and contact details.
HEADS UP: Procedure for the chair person and/or appointed trustee when dealing with unruly and/or unacceptable behaviour of guests and/or owners
PROCEDURE:
- Contact the Owner and ask her/him to get the guests to settle down.
- In the case that this fails, contact Fair Brothers Security to come and inform the guests to settle down.
- If the guests continue to be unruly, please contact Fair Brothers Security to approach the guests once again.
- The Police will be called in if Fair Brothers Security cannot get the guests to settle down.
- Fair Brothers Security’s call out fee of R2 000,00 is payable by the Owner of the unit where the unruly and/or unacceptable behaviour was.

The Paddocks Body Corporate’s Conduct Rules:
- Section 15 (1) No business or hobby which may irritate or disturb residence will be allowed.
- Section 7 (1): The owner or occupier of a section must not create noise likely to interfere with the peaceful enjoyment of another section or another person’s peaceful enjoyment of the common property.
- Section 7 (3): The owner or occupier of a section must take reasonable steps to ensure that the owner or occupier’s visitors do not behave in a way likely to interfere with the peaceful enjoyment of another section or another person’s peaceful enjoyment of the common property.
- Section 7 (4): The owner or occupier of a section is obliged to comply with these conduct rules, notwithstanding any provision to the contrary contained in any lease or any other grant of rights of occupancy.
- Section 13 1 (e): An owner must not use his or her section or exclusive use area, or permit it to be used, in a manner or for a purpose which may cause a nuisance to any occupier of a section.
Conclusion:
Activities that irritate or disturb or interfere with the peaceful enjoyment of another section cannot be allowed as stipulated in the Conduct Rules, as well as the Sectional Title Management Act and the Prescribed Rules and Regulations.
MOVING OUT/SELLING
Owners selling their units must inform the managing agent and the trustees of the sale, and provide them with the details (names and contact details) of the buyer, and the date of occupancy.
LITTERING/RUBBISH/REFUSE REMOVAL
Owners/tenants shall
- maintain in a hygienic and dry condition, a rubbish bin inside their exclusive areas;
- deposit their refuse in the garbage facility next to the entrance.
- Building rubble, garbage or any other rubbish (including cigarette butts, food scraps, pet waste) may not be dumped on the common area.
PETS
Allowed, except for reptiles, as long as these pets do not disturb the peace, or endanger anyone. Pets are not to roam unattended in the common areas.
ENTRANCE GATE
The entrance gate has a 30 second period in which it remains open. Please keep this in mind when entering/exiting. Please ensure that the gate properly closes after the process of entering or exiting.
SECURITY
Vehicle access gate remote controllers are to be limited to owners/tenants and not to be made available to domestic workers and contractors without consent from the trustees.
SIGNS/NOTICES
Owners/tenants are not allowed to place any sign, notice, billboard or advertisement of any kind whatsoever on any part of the common property or of a section, to be visible from outside the section, without the written consent of the trustees.
APPEARANCE FROM OUTSIDE
Owners/tenants are not allowed to place or do anything on any part of the common property which, at the discretion of the trustees, is aesthetically displeasing or undesirable when viewed from the outside of the section.
FIREHOSE
These are installed in locations that are easily accessible and are used to extinguish or contain small fires. It is illegal to use or tamper with fire equipment except as may be necessary during emergencies.
INSURANCE
The Body Corporate Insurance does not cover the contents of the properties.
LEVY
Levies are payable on the first of each month. Levy invoices are emailed no later than the 28th monthly. The levies do not include the municipal bill (property tax and services).
VEHICLES
- Vehicles having a gross vehicle weight over ten tons, shall not be permitted to enter the Paddocks.
- Park in front of the garage. Stay off the grass and out of the gardens. Damage to the garden will be repaired at the expense of the owner. Unauthorised parking will result in the vehicle being towed away at the expense of the owner.
Parking Guidelines
While we acknowledge that parking space is limited, we need your cooperation with the following:
• Three vehicles maximum if your specific area allows it
• Two vehicles maximum in areas with restrictions
• Please be considerate to your neighbours and avoid inconveniencing them
• Whenever possible, please stay off the lawn when parkingAlternative Parking Arrangements
If you require alternative parking beyond your allocated spaces, please discuss this directly with other unit owners who may be able to assist with available parking. This ensures clear communication and mutual agreement between us.
- Owners/tenants shall ensure that their vehicles do not drip oil/fluids on any area of the common property or areas of exclusive use.
- Owners/tenants are not allowed to service (dismantle or effect major repairs) any vehicles on any portion of the common property or areas of exclusive use.
- A speed limit of 5 kilometers per hour must be maintained by all vehicles on any portion of the common property.
Speeding
Please drive slowly and carefully while on the Paddocks premises. Speeding poses a serious risk to residents, rodents, children, and pets.
CHILDREN
Parents shall accept responsibility for their children when in the communal areas.
DOMESTIC WORKERS
Owners or tenants may employ personal workers to work in the unit providing they take responsibility for and ensure that their workers adhere to the rules and regulations.
MAINTENANCE
- The Body Corporate will be liable for the maintenance of the Municipal Area between the existing donga and the border of Erf 2218, Clarens and on which the sectional title is opened and enclosed together with the estate, to secure the safety of the members and their assets.
- All owners are allowed to fence off a piece of the commonage, subject thereto that only picket-fencing is allowed, no higher than 1.8 meters and equipped with a gate for garden services to gain access. The extent of the garden was determined by the developer but may be amended by the trustees.
- Painting of the common property walls and the outside of units are standardised: Dulux Weatherguard white.
- Owners are responsible for the maintenance of their properties and personal areas.
GARDEN AND GARDENERS
- Maintenance of the common area and gardens will be undertaken by the trustees of the body corporate. Owners or tenants are not allowed to command the official gardeners at any time. Requests for assistance must be directed to the caretaker. The gardeners follow a set schedule. Read more
- Owners are entitled to care for the immediate garden of their units. Maintenance of these private areas is the responsibility of the owners.
- The use of chemicals or pesticides, other than household cleaning chemicals, that are toxic to birds and pets, are forbidden.
DAMAGE/ALTERATIONS TO THE COMMON PROPERTY
Owners or tenants shall not mark, paint, drive nails or screws into, or otherwise damage or alter, any part of the common property without first obtaining the written consent of the trustees, make alterations to a section or an exclusive use are that are likely to impair the stability of the building or interfere with the use and enjoyment of other sections, the common property or any exclusive use area or has a material negative affect on the value or utility of any other section.
Owners or tenants may install the following items in their sections, provided that they adhere to the specific guidelines outlined below:
- Locking Devices
Owners or tenants are permitted to install locking devices on doors, windows, or other entry points to enhance security. All installations must comply with safety regulations and not interfere with the property’s structural integrity. - Safety Gates
Safety gates may be installed for the protection of children, pets, or to restrict access to certain areas. The design, material, and installation must align with the community’s aesthetic and safety standards. - Burglar Bars or Other Safety Devices
Owners or tenants may install burglar bars, security screens, or similar safety devices to protect their sections. This includes the use of screens to prevent the entry of animals, reptiles, or insects. All devices must be secure, durable, and installed in a manner that maintains the visual harmony of the building or property. - White Picket Fences
Erection of white picket fences is allowed, provided they follow the specific design and height guidelines attached. Fences must be installed in accordance with the approved style to ensure consistency within the community, i.e. Pine or Maranti wood, painted white, sealed at heights 1.5 and 1.8m. - Water Tanks
The installation of water tanks is permitted according to the attached guidelines. Owners or tenants must ensure that tanks are installed discreetly, are well-maintained, and do not obstruct any communal areas or utilities. Follow this link to detailed specs. - Solar Panels
Solar panels may be fixed to roofs in accordance with the attached guidelines. These installations must be positioned and constructed in a way that minimizes visual impact while ensuring proper functionality and compliance with all relevant regulations. Follow this link to detailed specs.
PESTS
It is the responsibility of the owners to keep their sections free of ants, borer or any wood-destroying insects and to this end shall permit the trustees and their duly authorised agents/employees, to enter their sections to inspect and if necessary to eradicate such pests. The cost incurred of such inspection, eradicating of insects and fixing of any material damaged by the pests shall be borne by the owners of the sections concerned.
STORAGE OF INFLAMMATORY MATERIAL AND OTHER DANGEROUS ACTS
Owners and/or residents shall not store any material or do, or permit, or allow to be done, any dangerous activity in the buildings or on the common property which will or may increase the rate of the premium payable by the body corporate on any insurance policy.
CATAPULTS AND FIREARMS
Nobody shall be allowed to discharge any firearm, including air guns and catapults in any area of the property except in self-defense.
GAS EQUIPMENT
All gas equipment, fittings and connections must be certified fit for duty every five years by a qualified gas specialist. Read more
FIREWORKS
Fireworks are not allowed ever.
SERVITUDES
The Body Corporate is bound to consent to the registration of servitudes for essential services should it become necessary to relay or expand the existing water-, sewer-, and electricity pipelines in future.
INTERNET CONNECTION
The Paddocks Body Corporate signed a contract with Internet SA to be the sole provider of fibre internet connection to the property. No masts and cables are allowed on the property.
